Mediation Model Clauses

"Mediation + Arbitration" Model ClauseⅠ: before the dispute

"Any dispute arising from or in connection with this Contract shall be submitted to Shenzhen Court of International Arbitration (SCIA) Mediation Center for mediation. If any party quits the mediation or the mediation fails, the dispute shall be submitted to the SCIA for arbitration."

"Mediation + Arbitration" Model ClauseⅡ: after the dispute

"The parties agree to submit the dispute to Shenzhen Court of International Arbitration (SCIA) Mediation Center for mediation. If any party quits the mediation or the mediation fails, the dispute shall be submitted to the SCIA for arbitration."

"Mediation + Arbitration" Model ClauseⅢ: Arbitral Award based on settlement agreement

The parties agree to submit the settlement agreement to the SCIA to request that an arbitral award be rendered in accordance with the Arbitration Rules and based on the terms of the settlement agreement. The Arbitral award is final and binding to both parties.
