It is an honour to be able to offer a few brief remarks as a representative of SCIA arbitrators, and in particular to offer a perspective as a foreign member of the SCIA's panel of arbitrators.
It is important to highlight, at the outset, the SCIA's remarkable growth and development over past few decades. I have been quite fortunate to be able to witness and, in a very modest way, contribute to that development during my time in Shenzhen and at STL, PKU's School of Transnational Law.
The relationship between the SCIA and STL is exceptionally valuable and continues to deepen. STL's educational model - which emphasizes the importance of transnational law, including international dispute resolution - is a natural fit for the SCIA.
Indeed, President Liu has been supporting STL from the beginning and I do mean the very beginning - by participating in STL's Dedication Ceremony in 2008. The SCIA's active engagement with many of the world's leading arbitration institutions - including ICSID, the Dubai International Arbitration Centre, the Singapore International Arbitration Centre, and the New York International Arbitration Center, reflect an open, ambitious, entrepreneurial spirit; the global arbitration community recognizes and admires that spirit.
As a representative of SCIA arbitrators, I would first note that as a foreign member of the SCIA panel of arbitrators, I am one of many. More specifically, I am one of more than 500 SCIA arbitrators who are from a foreign jurisdiction. Arbitrators from foreign jurisdictions account for more than one-third of all SCIA arbitrators; indeed, according to the SCIA's just-released 2023 statistics, that percentage is nearly 37%.
With respect to internationalization, such a significant presence of foreign arbitrators is important and impressive. Another important statistic, for purposes of internationalization, is that in 2023, overseas arbitrators participated in more than 200 SCIA case hearings.
These numbers are encouraging and should be applauded. In particular, the focus, in the just released SCIA 2023 statistics, on arbitrator participation in live disputes is particularly welcome and relevant.
Assembling international talent and activating international talent are distinct goals and distinct achievements. Assembling international talent can inspire confidence among the global users of international arbitration and the global arbitration community of lawyers, experts, arbitrators and scholars.
But with respect to inspiring confidence globally, activating international talent - meaning, in this context, appointing foreign arbitrators and experts in live disputes – it can accomplish far more. Live disputes lead to concrete outcomes; those outcomes, in turn, can be evaluated, scrutinized, and, ultimately accepted by the public.
For the SCIA, and more generally, for the ongoing development of world class dispute resolution services in China, this relationship between international talent and acceptable dispute resolution outcomes should be highlighted.
Foreign arbitrators with well-developed profiles can contribute to the advancement of dispute resolution services in China, and to the advancement of the SCIA's global profile, by affiliating themselves with the SCIA and other leading dispute resolution organizations in China.
But the contributions of such individuals can take on far greater significance when they are given opportunities to showcase their world class skills and expertise in live cases, where there will be concrete outcomes that are of great significance to the disputing parties.
I congratulate the SCIA on a panel of arbitrators that now covers 114 countries and regions; on the SCIA Council whose members, by 60% majority are from overseas; and on an FDI Moot Shenzhen competition that featured arbitrators from 46 countries and regions.

作为SCIA仲裁员的代表,我首先要指出,我是SCIA境外仲裁员中的一名。具体而言,我是来自境外的569名SCIA仲裁员中的一名。境外仲裁员占SCIA仲裁员总数的三分之一以上,根据SCIA刚发布的2023年度数据概览,境外仲裁员的比例接近37%。
就国际化而言,大量境外仲裁员进入SCIA仲裁员名册是非常重要且令人印象深刻的。另一个我关注到的SCIA国际化发展的重要数据是2023年境外仲裁员参与了200多个SCIA案件的审理。
我认为这些数据令人非常振奋并且值得被表扬。特别是在刚发布的SCIA 2023年数据概览中,对境外仲裁员参与案件审理的情况进行了统计,这是境外仲裁员倍加关注的数据。

但就鼓舞国际仲裁信心而言,激活国际人才就意味着要在解决实际争议中指定外国仲裁员和专家,他们可以在实际的争议解决案件中起到更多的作用。案件的结果能够被用来评估、审查,最终能够被公众所接受。
总体而言,对于中国面向全球的争议解决服务的持续发展,SCIA应该强化国际人才与可接受的争议解决结果之间的关系。
但是,当这些仲裁员有机会在案件审理中展示他们的技能和专业知识时,才能其作出更具重大意义的贡献,而那些案件也会产生对争议双方更有意义的结果。
在此,我祝贺SCIA拥有一个覆盖114个国家和地区的仲裁员名册;拥有理事会治理机制,并且其中有60%的理事来自港澳和海外;以及每年举办的FDI MOOT SHENZHEN,广泛吸纳了来自46个国家和地区的裁判。
