深圳国际仲裁院关于修正仲裁规则的公告

为帮助仲裁当事人高效化解纠纷,深圳国际仲裁院修正《深圳国际仲裁院仲裁规则》个别条款,扩大快速程序适用范围,将适用快速程序案件争议金额的上限标准调整至人民币1,000万元。该修正案经深圳国际仲裁院第三届理事会第七次会议审议通过,自2024年10月1日起施行。自施行之日起受理的案件,适用该修正案的有关规定;施行前受理的案件,当事人一致同意的,也可以适用该修正案的有关规定。

附件:《深圳国际仲裁院仲裁规则》修正案
(深圳国际仲裁院第三届理事会第七次会议通过)
一、《深圳国际仲裁院仲裁规则》第五十六条第(一)款修改为:“凡争议金额不超过人民币1,000万元的,或争议金额超过人民币1,000万元但经当事人书面同意的,或当事人约定适用快速程序或简易程序的,适用快速程序。”
二、《深圳国际仲裁院仲裁规则》第六十一条第(二)款修改为:“变更后的仲裁请求或反请求所涉及的争议金额超过人民币1,000万元的,经一方当事人请求或者仲裁庭提议,仲裁院认为有必要的,仲裁院可以决定将快速程序变更为普通程序。”
三、《深圳国际仲裁院仲裁规则》第六十一条第(三)款修改为:“原适用普通程序的案件,仲裁庭组成前,申请人变更仲裁请求的,变更后的仲裁请求金额不超过人民币1,000万元的,适用快速程序;仲裁庭组成后,仲裁请求的变更或反请求的提出,不影响普通程序的继续进行。”
本修正案自2024年10月1日起施行。
Announcement of the Shenzhen Court of International Arbitration
on Amending the Arbitration Rules
In order to assist parties in resolving disputes efficiently, the Shenzhen Court of International Arbitration (SCIA) has made amendments to certain clauses of the SCIA Arbitration Rules, which further extend the scope of the application of Expedited Procedure and raise the upper limit of the amount in dispute applicable to Expedited Procedure to RMB10,000,000. These amendments (the "Amendments") were adopted by the Third Council of SCIA at its seventh meeting, and shall take effect from October 1, 2024. The Amendments shall apply to all cases accepted by the SCIA on or after the date the Amendments take effect. For cases accepted by the SCIA before the Amendments take effect, the Amendments shall apply upon the consent of the parties.

Shenzhen Court of International Arbitration
Amendments to the SCIA Arbitration Rules
(Adopted by the Third Council of Shenzhen Court of International Arbitration at its seventh meeting)
1. Article 56(1) of the SCIA Arbitration Rules is amended as follows: “Expedited Procedure shall apply to any case where the amount in dispute does not exceed RMB10,000,000; or to any case where the amount in dispute exceeds RMB10,000,000 but the parties agree in writing that the Expedited Procedure shall apply; or to any case where the parties agree to apply the Expedited Procedure or Summary Procedure.”
2. Article 61(2) of the SCIA Arbitration Rules is amended as follows: “Where the amount in dispute of the amended claim or that of the counterclaim exceeds RMB10,000,000, upon one of the parties’ request or the suggestion of the arbitral tribunal, and if the SCIA considers it necessary, the Expedited Procedure may be changed to the general procedure by the SCIA.”
3. Article 61(3) of the SCIA Arbitration Rules is amended as follows: “For any case that originally applies the general procedure, if the Claimant amends its claims before the formation of the arbitral tribunal and the amount in dispute as amended does not exceed RMB10,000,000, the Expedited Procedure shall apply. The application of the general procedure shall not be affected by any amendment to the claim or by the filing of a counterclaim after the formation of the arbitral tribunal.”
These Amendments shall take effect from October 1, 2024.
